Montana Citizens Demanding Lawsuit on Democratic Healthcare Scheme

By JC Leahy

I don't have much information about this yet, but Montana citizens are apparently pressuring their State to sue the Federal Government to declare the recently-enacted Democratic healthcare scheme unconstitutional.  Numerous state governments have already filed lawsuits.  This should be a no-brainer if it gets to the Supreme Court -- but you never know...

RyAnn Christman Erskine  in a Facebook post writes:

"Let the attorney General know what you think of the health care bill Attorney General Steve Bullock Department of Justice P.O. Box 201401 Helena, MT 59620-1401 Phone: (406) 444-2026 Fax: (406) 444-3549 E-mail: contactdoj@mt.gov "

All I can say is that now is the time for all good people to come to the aid of their country.

ALSO, someone is organizing a million-person march on Capitol Hill.  Here's the contact e-mail:

According to Jeff Lowe on Facebook, the Montana Attorney General Steve Bullock has issued this response by e-mail:

Steve Bullock refuses to join the fight against Obamacare
This is the email response to the concerns of Montanans about Obamacare: March 25, 2010 Thanks for expressing your concerns about the constitutionality of the recent health care legislation. We have reviewed the legal arguments that are being used to challenge th...e legislation, and have concluded that it is highly unlikely it will be found unconstitutional. This is a conclusion that is shared by the vast majority of legal scholars, liberal and conservative, who have reviewed the issues. As a result, Montana will not be joining the lawsuit that several state Attorneys General have brought. People can certainly disagree over whether the health care legislation is good policy. That does not mean, however, that the State of Montana should spend taxpayer money to file a lawsuit that we do not believe has legal merit. Like the Republican and Democratic Montana Attorneys General who served before me, I try hard to keep my personal political beliefs out of legal decisions. My staff and I are busy and working hard to protect the interests of Montanans. The courts will have the opportunity to judge the merits of the challenges to the health care legislation without the involvement of Montana. If we are correct and the courts reject the challenges, we will have saved valuable Montana taxpayer resources. In the unlikely event that the Courts declare the legislation unconstitutional, their decision will apply to all Americans - including all Montanans - even though we weren't a party to the lawsuit. Sincerely, STEVE BULLOCK Attorney General

Jeff Lowe says: Gary MacLaren, HD 89, was among the principal authors. The sooner the legislature gets called into session the better. We don't have to wait until 2012, the normal time for the MT legislature to be called will be in January of 2011, when this act can be adopted, but by then the damage might already be done.

If a majority, GOP, Democrats or Other, of the new legislature gets behind this bill then it gets passed.
